Come January, President Barack Obama will be consigned to the sidelines as Donald Trump occupies the Oval Office and begins the work of dismantling his legacy. But there is one action that Obama could take on January 3, 2017 that could hold off some of the worst potential abuses of a Trump administration for up to a year. Obama can appoint his nominee Merrick Garland to the Supreme Court on that date, in between the two sessions of Congress.  Based on everything we know about Obama’s temperament and politics, he won’t resort to this.

Wall Street may find a testy relationship with Donald Trump's White House if comments by one of his senior advisers are any indication. In a presentation Steve Bannon gave during a conference at the Vatican in 2014, the Trump confidant ripped into big banks and their role in the 2008 financial crisis. He rued that no one ever was held accountable, which he said helped fuel populist fury and groups like the tea party, according to a transcript of his remarks that Buzzfeed published Wednesday. Bannon ultimately would take the reins of the Trump campaign and will be the White House chief strategist when Trump is sworn in Jan. 20.

In an otherwise grim election for Democrats, North Carolina progressives celebrated a victory that, while receiving little attention nationally, had the potential to deliver big results in the state: A black Democrat named Mike Morgan defeated the state’s most senior associate justice on the North Carolina Supreme Court, tilting the court’s balance of power in favor of Democrats.  North Carolina’s highest court has become the arbiter of some of the state’s most controversial issues.

In the week since Donald Trump's election, a rash of racist, anti-Muslim, and anti-Semitic incidents—from chants of "Build that wall!" to swastika graffiti—have surged inside classrooms, on college campuses, and in communities around the country.  As of Monday, the Southern Poverty Law Center had collected more than 400 allegations of election-related intimidation and harassment nationwide. The SPLC has been sounding the alarm for months about the so-called "Trump effect" in America's schools—the rise of classroom bullying and harassment driven, at least in part, by the antagonistic rhetoric of the presidential campaign—and more than one-third of the incidents it has tracked took place at K-12 schools or universities.
